Please follow the writing format:
1. (If you mailed your OPT/STEM OPT packet out to USCIS) The date that you sent out the OPT application packet to USCIS: 02/05/2022 and confirmed that USCIS received the OPT application by 02/08/2022.
The student initially was recommended for OPT in December 2021 and the student failed to graduate on time. As the student had not submitted the application to USCIS, the student’s OPT recommendation was just canceled on SEVIS by DSOs. When the student completed all the courses, the student was re-recommended for OPT in February 2022 and the student ensured that USCIS received the OPT application before the grace period ends.
USCIS denied the application based on the first OPT recommendation date and said “You have failed to submit Form I-765 within 30 days of the date the DSO entered the recommendation for OPT in your SEVIS record.” DSOs had a student complete the DHS Form 7001, Request for Case Assistance and they also sent an email with the evidence to USCIS.
The student received Form I-797 on March 11, 2022, which says the OPT application has been approved. EAD card arrived on March 21, 2022. USCIS approved start date was one month after the DSO recommended OPT start date to prevent a student from accruing unemployment days due to their errors.
